1. Introduction and Purpose

Welcome to Tide Tribe! These Terms of Service ("Terms") govern your use of our website (www.tidetribe.co.za), mobile applications, live beach camera feeds, and any related features or services (collectively, the "Services"), operated by Tide Tribe (PTY) LTD.

By accessing or using our Services, you agree to these Terms, our Fair Use Policy, and our Privacy Policy, and consent to be bound by South African law, including the Protection of Personal Information Act, 2013 (POPIA).

2. Acceptable Use

• Viewing Live Camera Feeds
• Accessing Recorded Clips
• Using Account Features
• Engaging with the Community
• Purchasing Content for personal use

3. Prohibited Use

• Commercial use without permission
• Using bots, scrapers, or automated tools
• Misrepresenting content or authorship
• Infringing intellectual property rights
• Bypassing security controls or restrictions
• Illegal or harmful conduct
• Excessive Use: Engaging in any use of the Services that places an unreasonable or disproportionately large load on our infrastructure, bandwidth, or systems, as determined at our sole discretion.
• Sharing accounts or impersonating others

4. Marketplace & Creator Content

Creators: You must own or have licenses to all content uploaded. You grant Tide Tribe a non-exclusive license to host, display, and sell your content.

Buyers: Purchased content is licensed for personal use only. No resale or commercial use without written consent.

Ownership: All content remains property of its creator or Tide Tribe unless otherwise stated.

5. Privacy & Data Protection

We comply with POPIA. See our Privacy Policy for how your personal information is handled.

6. Age Restrictions

You must be 18+ or have permission from a legal guardian to use the Services.

7. Limitation of Liability

To the fullest extent allowed by law, Tide Tribe is not liable for indirect, incidental, or consequential damages, including interruptions, lost data, or reliance on service accuracy.

8. Enforcement and Consequences

• Written warnings
• Restricted access
• Temporary suspensions
• Permanent bans for serious or repeat offenses

No refunds will be issued if your account is terminated due to violations.

9. Dispute Resolution

Disputes will be resolved informally first. Unresolved issues will be subject to the courts of KwaZulu-Natal, South Africa.

10. Changes to These Terms

We may update these Terms. Material changes will be communicated. Continued use constitutes acceptance.
