These Creator Terms of Service ("Agreement") govern your participation as a content creator ("you" or "Creator") on Tide Tribe (PTY) LTD ("we", "our", or "Tide Tribe"), and apply in addition to our general Terms of Service and Privacy Policy.
For the purposes of this Agreement:
You must be 18 years or older, or have permission from a legal guardian, to become a creator on our platform.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Tide Tribe is not liable for any loss arising from your failure to protect your account security.
You are an independent contractor, not an employee, agent, or partner of Tide Tribe. You are solely responsible for all taxes, withholdings, and insurance required by your jurisdiction.
To maintain the specific focus of Tide Tribe, you agree to the following content guidelines:
We reserve the right to determine, in our sole discretion, whether Content meets these criteria.
You keep 100% ownership of all the content you upload to Tide Tribe. We will never claim any rights to your work.
To operate our service, you grant us a limited license to use your content. This allows us to:
This license is non-exclusive (meaning you can post and sell your work anywhere else), royalty-free (we don't pay you to use it in this way, as its purpose is to power your account), and worldwide (so it can be accessed from anywhere). The license ends when you remove your content from our platform.
Creators are responsible for ensuring all content is original and properly licensed. You agree not to upload any content that infringes on third-party rights or violates South African law.
Creators may set their own prices. Tide Tribe charges a flat service fee of 12% on all transactions.
Revenue is paid out Bi-Weekly to your designated bank account via EFT, provided you have met the minimum payout threshold of R50. All transactions are processed in South African Rand (ZAR). Creators are responsible for any taxes owed on their earnings.
If a transaction is refunded or subject to a chargeback (e.g., credit card dispute), we reserve the right to deduct the corresponding amount, including any associated fees, from your future earnings. If your balance is insufficient, you agree to reimburse us upon demand.
We reserve the right to remove any content that violates our policies, including the Permitted Content guidelines, or applicable laws. We may delete old or inactive content at our discretion, especially from inactive accounts.
Either party may terminate this agreement at any time. Upon termination, we will remove your content and pay out any outstanding earnings above the minimum threshold.
You agree to indemnify Tide Tribe against any claims, losses, or legal action resulting from the content you upload. Tide Tribe is not liable for any loss of income or data due to outages, bugs, or service downtime.
Any disputes will first be resolved informally. If unresolved, they will be subject to the jurisdiction of the courts of KwaZulu-Natal, South Africa.
We may update this agreement from time to time. Continued use of the platform constitutes acceptance of the revised terms.
While Tide Tribe takes steps to prevent unauthorized use of content by buyers, we are not responsible for any misuse, including unauthorized commercial use. As the content owner, you retain the right to take legal action against infringing users. Upon request and where lawful, we may assist you in identifying offending buyers.
