These Creator Terms of Service ("Agreement") govern your participation as a content creator ("you" or "Creator") on Tide Tribe (PTY) LTD ("we", "our", or "Tide Tribe"), and apply in addition to our general Terms of Service and Privacy Policy.
You must be 18 years or older, or have permission from a legal guardian, to become a creator on our platform.
You keep 100% ownership of all the content you upload to Tide Tribe. We will never claim any rights to your work.
To operate our service, you grant us a limited license to use your content. This allows us to:
This license is non-exclusive (meaning you can post and sell your work anywhere else), royalty-free (we don't pay you to use it in this way, as its purpose is to power your account), and worldwide (so it can be accessed from anywhere). The license ends when you remove your content from our platform.
Creators are responsible for ensuring all content is original and properly licensed. You agree not to upload any content that infringes on third-party rights or violates South African law.
Creators may set their own prices. Tide Tribe will take a platform fee from each sale, currently:
Revenue is paid out Bi-Weekly, provided the creator has met the minimum payout threshold set at R50. Creators are responsible for any taxes owed on their earnings.
We reserve the right to remove any content that violates our policies or applicable laws. We may delete old or inactive content at our discretion, especially from amateur accounts. Professional content may remain online longer to preserve catalog continuity.
Either party may terminate this agreement at any time. Upon termination, we will remove your content and pay out any outstanding earnings above the minimum threshold.
You agree to indemnify Tide Tribe against any claims, losses, or legal action resulting from the content you upload. Tide Tribe is not liable for any loss of income or data due to outages, bugs, or service downtime.
Any disputes will first be resolved informally. If unresolved, they will be subject to the jurisdiction of the courts of KwaZulu-Natal, South Africa.
We may update this agreement from time to time. Continued use of the platform constitutes acceptance of the revised terms.
While Tide Tribe takes steps to prevent unauthorized use of content by buyers, we are not responsible for any misuse, including unauthorized commercial use. As the content owner, you retain the right to take legal action against infringing users. Upon request and where lawful, we may assist you in identifying offending buyers.
